Gear Box (“Company” or we” or “us”) operates www.gearboxsports.com and any other website (collectively, “Website”) that links to this  Privacy Policy (our “Privacy Policy”), which describes the types of information we may collect from you or that you may provide when you visit the Website and our practices for collecting and using such  information. 

This Privacy Policy applies to information we collect via the following “Services”:

·       on our Website; and

·       via email, text, and other electronic messages between you and us regarding the offerings on our Website.

It does not apply to information collected by:

·       us offline or through any other means, or by any third-party or by any third-party site or application that may link to the Website; or

·       us with respect to our employees or prospective employees.

2. Children 

We do not knowingly market to children. Our Services are not intended for children under 18 years of age (or such higher age of majority if higher than 18 where they reside). We do not knowingly collect information that could identify a specific individual from children under 13, and if we learn we have collected or received such information  from a child under 13, we will promptly delete that information. However, Personal Data does not include any deidentified or aggregated information.

We collect the following types of Personal Data that you provide to us when you access or use our Services: real name, postal address, email address, telephone number, account name and log-in, age, gender, veteran or military status, and records of purchases obtained, or considered to be obtained from us. You also need to provide payment information to make purchases with us, but we do not process the payments. They are processed by a third party payment processor on our behalf. In addition, we also collect Personal Data of the kind indicated above that you may provide when you fill out a form we make available online (e.g., for a sponsorship requested from us, to sign up for emails or texts) or through your correspondence with us. 

We may ask for your name and contact information (i.e., email) if you request customer support from us online, enter a contest or promotion sponsored by us via the Website, complete an online survey for our research purposes, or offer to collaborate with us as a business partner or supplier.

You can review and change your Personal Data by logging into the Website and visiting your account profile page. Please update your Personal Data through your account with us if it changes or by contacting info@gearboxsports.com. You may also close your account with us at any time. We reserve the right to retain information relating to your account and interactions with us as needed for our legal compliance purposes. 

If you’d like to stop receiving marketing emails from us, please click “unsubscribe” within the email or make a request to info@gearboxsports.comYour electing not to receive marketing emails does not mean we will stop emailing you product order information, warranty information, respond to you when you email us, or provide notifications relating to your business relationship with us, such as updates to this Privacy Policy.  

7. Do Not Track Signals

Some web browsers permit you to broadcast a signal to websites and online services indicating a preference that they “do not track” your online activities. At this time, we do not honor such signals and we do not modify what information we collect on the Website (described above) or how we use that information based upon whether such a signal is broadcast or received by us. Third parties, other than our vendors assisting with making the Website available do not have authorization from us to track your uses of the Website or track what other activities you may have engaged in before or after using the Website (for example, using a different website). That said, we cannot control third-party tracking and there may be some third-party tracking that occurs without our knowledge or consent.

We take commercially reasonable steps to secure Personal Data from unauthorized access and use but you are also responsible for keeping your account log-in details confidential.   Unfortunately, the transmission of information via the internet is not completely secure and we cannot guarantee security measures will hold 100% of the time. Any transmission of Personal Data online is at your own risk.  

9. Notice for California Residents 

Pursuant to Section 1798.83 of the California Civil Code, residents of California have the right to request from a business with whom the California resident has an established business relationship what types of personal information, if any, the business shares with third parties for direct marketing purposes by such third parties and the identities of the third parties with whom the business has shared such information in the immediately preceding calendar year.  We do not currently share any personal information with third parties for direct marketing by such parties[A2]  to you for their own purposes.  If you have any questions, comments or requested related to this Section, please contact us using the information in Section 12 (“Contact Information”) below.  A number of states are currently considering enacting laws similar to the California law above.  If you are a resident of a state that enacts such a law, please use the contact information above to contact us with any questions, requests or comments.

We are headquartered in the United States and currently our Website is only intended for individuals located in the United States. If you are located outside of the United States, be advised that any information you provide to us will be transferred to and stored in the United States and that, by submitting information to us, you explicitly authorize its transfer and storage within the United States.  We will protect the privacy and security of Personal Data according to this Privacy Policy regardless of where it is processed or stored.

We may change this Privacy Policy at any time. When we do so we will  post  changes we make to our Privacy Policy on this page, and provide notice of changes in such other manner as we determine.
